The Turf Moor Memorial Gardens

 

1.1 The Turf Moor Memorial Garden (‘the TMMG’) is operated by BFC MEMORIAL GARDEN CO. C.I.C. whose registered office is at Turf Moor, Harry Potts Way, Burnley BB10 4BX and who are represented by the BFC Memorial Garden Committee (‘the Committee’).

 

Memorial Wall Plaque

 

2.1 The Memorial Wall Plaque must be purchased from the Committee.

 

2.2 The Memorial Wall Plaque will be displayed for a period of 10 years (‘the Display Period’) unless determined earlier as set out in these terms and conditions.

 

2.3 Only Memorial Wall Plaques as prescribed by the Committee will be permitted.

      

2.4 Wording of inscriptions on the Memorial Wall Plaques is subject to the approval of the Committee.

 

2.5 Inscriptions on the Memorial Wall Plaque are not to exceed the stipulated number of letters.

 

2.6 The Committee reserves the rights to refuse any inscription that it deems to be unsuitable.

 

2.7 Memorial Wall Plaques are not permitted to be amended in order to incorporate other names.

 

2.8 Memorial Wall Plaques are only to be fitted by Stevenson Memorials or such other provider as the Committee may decide from time to time.

 

2.9 Memorial Wall Plaques will be returned to the Applicant at the end of the Display Period, if possible, unless an extension to the Display Period is granted or the Memorial Wall Plaque is too badly damaged. Every care will be taken to ensure the Applicant receives the Memorial Wall Plaque in the best condition possible.

 

2.10 Memorial Wall Plaques will be maintained by the Committee against natural elements and effects. Acts of vandalism or other human interaction are not covered by these terms and conditions and in such circumstances the cost of repairs will be charged to the Applicant.

 

2.11 The Committee may remove the Memorial Wall Plaques temporarily to allow repairs or maintenance to be carried out to the TMMG.

 

2.12 If the Memorial Wall Plaques, or any replacement Memorial Wall Plaques cannot be displayed at the TMMG, for any reason, the Committee may terminate the rights granted to the Applicant and refund a proportion of the fee, equivalent to the proportion of the Display Period which would have remained but for the termination pursuant to this condition.

 

2.13 The Committee are responsible for the maintenance of the TMMG and its grounds and the authorised memorials contained within them. The Committee reserve the right to change the appearance and general layout of the TMMG at our discretion. The Committee will notify the Applicant before any significant changes are made.

 

Cremated Remains

 

3.1 A small cup of cremated remains (maximum of 12 fl-oz) may be scattered for free within the TMMG.

 

3.2 Cremated remains are only to be scattered at the designated area, specifically the area located in front of the Memorial Walls. Grass areas and flower beds should not be used to scatter ashes.

 

3.3 The strewing of cremated remains in the TMMG is not permitted.

 

3.4 All scatterings of cremated remains are to be organised through the Committee. This can be conducted via the website, email or visiting the reception at Turf Moor football ground.

 

3.5 No cost is made for the spreading of ashes within the TMMG, however it is requested that a donation be made to help maintain the garden areas.

 

3.6 Religious ceremonies can be held in the TMMG. These must be arranged and coordinated by the Applicant and permission must be gained from the Committee in

advance.

 

3.7 Ceremonies will not be held at the TMMG on a date allocated to a home game played by Burnley FC (including reserve games). Changes to dates of fixtures due to TV coverage may require that ceremonies must be cancelled at short notice by the Committee.

 

Fees and Charges

 

4.1 The price of the services (which includes VAT) will be the price set out in our price list in force at the date of your order unless we have agreed another price in writing.

 

General Provisions

 

5.1 The Applicant should inform the Committee of any change of address of the Applicant. It is the responsibility of the Applicant to ensure that this information is up to date. The Committee will only contact the Applicant by way of the postal address or email address that have been provided to them.

 

5.2 No grave identification marker, vases or any other article will be permitted to be placed within the TMMG.

 

5.3 No exclusive rights or burial will be granted.

 

5.4 The Applicant acknowledges that there is no relationship of landlord and tenant created between the Committee and the Applicant by these terms and conditions.

 

5.5 The planting of trees, shrubs, other plants, or any permanent tribute in the TMMG, other than an authorised Memorial Wall Plaque, is not permitted.

 

5.6 Interference with the Memorial Wall Plaques is not permitted.

 

5.7 The laying of wreaths, floral tributes, teddy bears, flowers, or any non-permanent tribute may be laid in front of the Memorial Wall. These are not to remain in situ for longer than 14 days, after which it will be disposed of. The Committee reserves the right to remove any item at any time.

 

5.8 Any wreaths, teddy bears, flowers, or any non-permanent tribute placed within the TMMG is done so at the owners’ risk. The Committee shall not be liable of the loss or removal of any item.

 

5.9 Children under the age of 14 years should be accompanied by a responsible adult when visiting the TMMG.

 

5.10 Only guide dogs and dogs for the disabled are allowed in the TMMG.

 

5.11 Photography and filming can only be permitted with prior consent from the Committee.

 

5.12 The following items are not permitted anywhere within the TMMG;

 

(a) Any item overlapping or outside the defined memorial area

(b) Glass vases or any other glass item

(c) Food and drink

(d) Chippings, pebbles and stones

(e) Fencing or borders of any kind around or within the TMMG

(f) Shrubs or trees

(g) Any item deemed to be offensive, unseemly or dangerous

(h) Any alcohol

 

5.13 All persons entering the TMMG do so at their own risk and the Committee shall not be liable (except in respect of personal injury or the death of any person caused by the Committee’s negligence). For any injury or damage sustained, regardless of the form of action, whether in contract, tort (including negligence or breach of statutory duty), strict liability or otherwise.

 

5.14 The Committee shall not be liable for personal property brought on to the site or for any damage or loss of memorials, tributes or memorabilia.

 

5.15 The Committee may transfer its rights and obligations under these terms and conditions to another organisation. The Committee will tell the Applicant in writing if this happens and the Committee will use reasonable endeavours to ensure that any such transfer will not affect your rights under these terms and conditions.

 

5.16 The Committee will use the personal information you provide to us to provide the services and to process your payment for such services.

 

5.17 The Committee will only give your personal information to third parties where the law either requires or allows us to do so.

 

5.18 The Committee may at any time vary, alter or revoke any stated terms or conditions.

 

5.19 This contract is between you and us. No other person shall have any rights to enforce

any of its terms.

 

5.20 Each of the paragraphs of these terms and conditions operates separately. If any court

or relevant authority decides that any of them are unlawful, the remaining paragraphs

will remain in full force and effect.

 

5.21 These terms and conditions are governed by English law and you can bring legal

proceedings in respect of the services in the English courts.
